Crown Seeks Incarceration for Criminal Negligence
Prosecutors argue that the 25-year-old mother deserves a substantial period of incarceration after pleading guilty to criminal negligence for failing to provide the necessaries of life. The incident occurred on September 9, 2024, when the woman took her three young children—ages five, three, and two—to the home of a man she had met through a dating application.
According to court documents, the mother left her children unattended while she engaged in sexual activity with her date in a bedroom. During this time, her five-year-old daughter accessed the backyard swimming pool through an unlocked door and ultimately drowned.
Defence Argues for Conditional Sentence
The defence lawyer, Alex Cardella, presented arguments for a conditional sentence that would allow the mother to serve her punishment at home. Cardella emphasized that his client, who serves as the sole caregiver to her two surviving children, has already received a lifelong lesson from the tragic events.
"She made a decision that she will regret for the rest of her life," Cardella told Ontario Court Justice Christine Malott during Monday's proceedings. "She doesn't need a period of incarceration in order to get the message across that you need to keep an eagle eye on your kids."
Sequence of Events Leading to Tragedy
Assistant Crown attorney Susan Landine detailed the circumstances that preceded the drowning, reading from an agreed statement of facts presented to the court:
- The mother had initially discovered her daughter attempting to access the backyard pool through an unlocked door
- She brought the children back inside, locked the door, and placed a stroller in front of it as a barrier
- She then returned to her date in the adjoining bedroom, leaving the door slightly ajar
- Approximately ten minutes later, she found the door unlocked again and the stroller moved aside
- Outside, her three-year-old son was screaming his sister's name beside the pool
The mother attempted to rescue her daughter but was unable to locate her in the "dark, murky green" water that obscured visibility to the pool's bottom. Police officers who responded to the scene retrieved the child and initiated life-saving measures before emergency paramedics arrived and assumed care. Despite these efforts, the five-year-old was pronounced dead at the hospital.
