The first impeachment article accuses Secretary Noem of obstruction of Congress. This charge stems from her alleged denial of lawmakers' access to Immigration and Customs Enforcement (ICE) facilities, preventing congressional oversight.

The second article alleges a violation of the public trust. It cites Noem's purported direction for Department of Homeland Security (DHS) agents to arrest individuals without warrants and her disregard for due process.

The third article accuses Noem of self-dealing, claiming she secretly steered a federal contract to a company operated by a personal friend.

A Political Uphill Battle and Democratic Resolve

Speaking to reporters, Rep. Kelly directly addressed Noem's previous dismissal of the impeachment effort as "silly." "I want to tell her right now, Secretary Noem, you have violated your oath of office, and there will be consequences," Kelly stated. "I am watching you. Members of Congress are watching you. The American people, most importantly, are watching you."

Co-sponsor Rep. Nydia Velazquez of New York was more blunt in her criticism of the agency's conduct. "This agency thinks it’s above the law," she fumed. "The most fundamental principle and value for the American people is fairness and humane policies, not beating the shit out of people."

Despite the strong rhetoric, the political math presents a formidable challenge. Republicans control the House of Representatives, meaning any successful impeachment vote would require unified Democratic support plus votes from some GOP members. Kelly acknowledged this reality but argued Democrats "need to use every tool in our toolbox" to ensure accountability within the administration.

The impeachment push occurs amid intense scrutiny of ICE following a recent incident where an agent fatally shot an American citizen in Minneapolis. This event has galvanized calls for sweeping DHS reforms.

Legislative responses are already taking shape. The nearly 100-member Congressional Progressive Caucus announced it will oppose new DHS funding without "meaningful" reforms. Senator Chris Murphy of Connecticut is drafting a bill with specific ICE changes, such as banning agents from wearing masks. Separately, Senator Catherine Cortez Masto of Nevada proposed legislation to redirect approximately $75 billion from ICE to local law enforcement programs.

When questioned about the possibility of abolishing ICE entirely—a position gaining public support according to recent polls—Rep. Kelly did not rule it out, stating, "All options are on the table."

The procedural path forward is lengthy. Impeachment would require a simple majority (218 votes) in the House. If achieved, a Senate trial would then need a two-thirds supermajority (66 votes) to convict and remove Noem from office, a high bar given current political divisions.
